Divorce is an emotional time in one’s life, and working with an objective and experienced attorney is necessary and beneficial. I help clients resolve issues that must be addressed immediately, but I also encourage clients to seriously consider the long-term ramifications of their choices, which may also involve other professionals. I work with clients and other professionals to address the issues, such as:
- Children : When children are involved in a divorce, the focus needs to be on what is in their best interest. Looking at the children’s age, parent interaction and history of parenting, we work together to create a parenting plan that focuses on the changing role both parents will have in raising healthy children while mitigating the negative consequences of divorce.
- Finances: During the divorce, I work with accountants and other professionals to handle complex and high-net worth assets. I also work with my clients to ensure they have a plan to survive financially after the divorce. Creativity and a well-planned separation agreement can give you the resources you need in a post-dissolution world.
- Mediation: Before a dissolution is granted, courts require the parties to attend mediation. I will advise you of your rights and provide you with a cost-benefit analysis of coming to a mutually agreed upon settlement. Using mediation to resolve domestic relations matters saves time and money, and it gives you the flexibility to create a solution tailored to your needs.This philosophy is true whether I am representing one individual or acting as the Mediator.
- Pre & Post-Nuptial Agreements: Although the intent of entering into marriage is a life long commitment unfortunately statistics dictate that this is quite often not the case. Entering into a prenuptial or postnuptial agreement will define the rights of each party if future events dictate that a dissolution of marriage is necessary. Entering into nuptial agreements not only clearly discloses the economic circumstances of each party so that each party can make informed decisions regarding the provisions contained within the nuptial agreement, but also allows each party to structure their own financial plan based upon the agreements contained within. Of course, there can also be provisions contained within the agreement which cause the nuptial to terminate/lapse upon a future event; i.e. if the marriage lasts beyond a certain amount of time. Further, entering into a nuptial agreement can save the party’s the financial costs of a future dissolution of marriage and may also allow an easier transition post-dissolution, especially if children are involved. Importantly, nuptial agreements are also extremely important when parties are entering into a second marriage and have children from their prior marriage whose interests they desire to protect.
